Experience

Attorney Richard Holland’s practice focuses on procurement, contract law, and the litigation and mediation of construction disputes. His experience includes representing municipalities in construction disputes before state and federal courts and the Office of the Attorney General; drafting and negotiating contracts for construction, design, engineering and project management services; and drafting and reviewing invitations to bid, requests for proposals and related documents. Attorney Holland also assists clients with a variety of municipal law issues, including town meetings, municipal charters and by-laws, conflict of interests, public records, the Open Meeting Law, and municipal finance.

Prior to joining the firm, Attorney Holland litigated and arbitrated complex construction disputes before the Massachusetts Superior Court and the American Arbitration Association. He also gained considerable experience in public sector contracting and procurement as a Deputy Attorney General with the New Jersey Department of Law & Public Safety. There, he litigated civil insurance fraud matters, and provided counsel to the New Jersey Economic Development Authority, assisting with procurement, and drafting contracts and agency regulations for the implementation of the then largest school construction program in the country.

Representative Matters

  • Obtained, on behalf of a town, payment of $2.75 million from a contractor and engineer in settlement of litigation arising out of a public construction project. Click here to download an article from the Middleborough Gazette regarding the settlement.
  • Obtained a decision of the court dismissing an approximately $1,000,000 claim of a contractor for lost profits and costs incurred in connection with a public construction project, and also won the plaintiff’s subsequent appeal of the court’s decision.
  • Obtained a decision of the court dismissing an approximately $282,000 claim of a contractor for delay damages in connection with a public construction project.
  • Obtained an award of $142,000 against a contractor and its surety in connection with the forfeiture of the contractor’s bid bond.
