Experience
Attorney Robert McKertich’s practice focuses on land use, environmental and general municipal law. In this capacity, he provides counsel to municipalities on zoning, subdivision, wetlands, water management and affordable housing issues and has experience representing clients before various administrative agencies, including the Division of Administrative Law Appeals, the Land Court, the Superior Court and the Appeals Court. Attorney McKertich also assists clients with a variety of municipal law issues, including town meetings, municipal charters and by-laws, conflict of interests, public records, the Open Meeting Law, and municipal finance.
Prior to joining the firm, Attorney McKertich was an associate at a private law firm where his practice focused on municipal, land use and environmental law. Mr. McKertich was also employed at the Massachusetts Division of Banks as a Bank Auditor where he examined the records of mortgage brokerage and lending institutions to verify compliance with state and federal lending requirements.
Representative Matters
- Eliades v. Town of Ayer Planning Board, 67 Mass.App.Ct. 1110 (2006). Won an appeal reversing a Land Court Judgment whereby the Appeals Court found that a determination of whether a mortgage agreement was granted in good faith and for valuable consideration so as to preclude the Ayer Planning Board’s authority to rescind a constructively approved subdivision plan under G.L. c.41, §81W is an issue of fact that could not be decided on summary judgment.
- Milazzo v. Town of Clarksburg Conservation Commission, Berkshire Superior Court C.A. No. 2006-00308 (2007). Successfully negotiated a settlement agreement on behalf of the Clarksburg Conservation Commission in a landowner’s challenge to an enforcement order issued by the Conservation Commission regarding the placement of fill in a wetlands resource area.
- Lynch v. Manchester-by-the-Sea Conservation Commission, Essex Superior Court C.A. No. 2006-00915 (2007). Won a Judgment upholding the Conservation Commission’s determination that a wetlands resource area abutting a landowner’s parcel is considered a “river,” rather than a “pond.”
- Town of Shirley v. Puma, Land Court Misc. Case No. 2007-336558 (2007). Obtained a Permanent Injunction prohibiting the operation of a landscaping business on a parcel located in a residential zoning district.
- Assisted the Town of Lancaster in drafting a Historic District Bylaw.
