Piper, Chief Justice of the Massachusetts Land Court.

Representative Matters

  • 3333 Inc. v. Town of Westminster, 100 Mass. App. Ct. 1116 (2021).  The Appeals Court affirmed a decision of the Superior Court that found that adjacent residential lots were not entitled to pre-existing non-conforming protections under the Zoning Act because the lots had merged by virtue of common ownership.
  • Tayeh Realty, LLC v. Town of Seekonk, Land Court Department, Docket No.: 22 MISC 000216 (Apr. 19, 2023).  In a case of first impression, succeeded in argument that the Land Court Department lacks subject matter jurisdiction to consider an appeal from a decision of a local Board of Selectmen to deny a fuel storage license under the Massachusetts Fire Prevention Statute.
  • Weatherlow Farms, LLC v. Zoning Bd. of Appeals of Westport, Bristol Superior Court, Docket No.: 2073CV00153 (Mar. 22, 2022).  Successfully defended the Zoning Board of Appeals’ decision that the sale of alcoholic beverages on a farm, but produced elsewhere, was not an agricultural use entitled to protection under local zoning bylaws and the Zoning Act.
  • Magida v. Town of Wellfleet Zoning Bd. of Appeals, Barnstable Superior Court, Docket No. 1972CV00408 (Oct. 13, 2022).  Successfully defended the decision of the Zoning Board of Appeals under General Laws Chapter 40B to grant a Comprehensive Permit to Habitat for Humanity for the construction of affordable single-family homes.
