Experience
Attorney Anne-Marie Hyland has over 20 years legal experience and for the past fifteen years has represented municipal clients in procurement and contract law, including general procurement, designer selection and public construction, and environmental law. She has also been the lead attorney in advising municipal clients on major transactional projects including for example the sale and privatization of a municipal hospital, the acquisition of a golf course as a municipal facility, the long-term lease of a former school building for private development as an assisted living facility, the negotiation of consent orders with the Department of Environmental Protection under environmental laws governing wastewater and solid waste disposal, and the procurement and negotiation of management contracts for the operation and maintenance of municipal facilities by private contractors. Her experience includes drafting legal opinions and documents for solicitation of contracts for goods and services, public construction projects, and the sale and lease of publicly-owned real property. She also reviews and drafts contract documents of all kinds.
In the area of general municipal law, Attorney Hyland assists clients in all areas of municipal law, including open meeting law, public records law, conflict of interest, municipal finance and Town Meeting.
Representative Matters
- Advising clients on the day-to-day mechanics of soliciting and evaluating bids and proposals under the Uniform Procurement Act, G.L. c. 7 for designer services, and G.L. c. 30 and 149 for public works and public building construction projects.
- Advising a town on the process for the sale of a major parcel of municipal land for use as a mixed-use residential and commercial development.
- Representing municipal clients in negotiation of consent orders for compliance with Department of Environmental Protection wastewater treatment regulation and advising clients during the compliance process.
- Assisting a town in the procurement process for the sale and privatization of a municipal nursing home and the construction of a new skilled nursing facility and assisted living complex, including the negotiation of an interim management agreement for continued operation of the municipal facility pending the completion of the facility’s license transfer to the new owner.
- Assisting a regional transit authority in the negotiation of a tri-partite Joint Development Agreement among the transit authority, a municipal government and a private developer for construction of a multimodal transportation facility under the new Federal Transit Administration Guidance for Joint Development Projects issued in 2007.
